Git ‘n’ Coffee Terms of Service #

Welcome to Git ‘n’ Coffee (gitncoffee.com). These Terms of Service ("Terms") govern your access to and use of Git ‘n’ Coffee’s website and services (the “Service”), which allow you to host and collaborate on Git repositories.

By using Git ‘n’ Coffee, you agree to these Terms. If you don’t agree, please do not use the Service.


1. Who Can Use Git ‘n’ Coffee #

You must be at least 13 years old and legally able to enter into a contract to use Git ‘n’ Coffee.

If you are under the legal age to use this Service in your jurisdiction or if local laws require parental consent, you may only use Git ‘n’ Coffee with the involvement and consent of a parent or guardian.

Git ‘n’ Coffee currently only supports individual (personal) accounts. Support for organizations and teams is planned, but not yet available. Once available, those features may be subject to additional terms.

You may use Git ‘n’ Coffee for personal, academic, or professional purposes as an individual.


2. Your Account #

To use Git ‘n’ Coffee, you need to create an account. You’re responsible for maintaining the security of your account and for all activity that occurs under it.

You must provide accurate and up-to-date information when creating your account. Do not share your login credentials.


3. Your Content and Repositories #

You retain ownership of any code, data, or materials ("Your Content") you upload to Git ‘n’ Coffee.

By uploading content to Git ‘n’ Coffee, you grant us a limited, non-exclusive license to store, display, and process Your Content to operate and improve the Service.

Git ‘n’ Coffee does not use Your Content (including code, repositories, or metadata) to train or fine-tune artificial intelligence or machine learning models. However, if your repository is public, it may be accessed by others (including third parties) who may use that content for purposes beyond Git ‘n’ Coffee’s control, including AI training.

You are responsible for the content you upload and the licenses you apply. Public repositories are visible to others, but your content is not open source or reusable by others unless you explicitly include an open source license file in your repository.

By default, repositories on Git ‘n’ Coffee are public. If you keep your repository public, you grant each user of Git ‘n’ Coffee a non-exclusive license to use, display, and perform your Content, but only as permitted by the license you include with your repository.

If you do not include a license file, others may view your code but do not have permission to use, reproduce, distribute, or create derivative works from it.

You are responsible for ensuring that your use of third-party content complies with applicable licenses.

Do not upload content you don’t have the rights to use, or that violates laws, infringes on intellectual property, or contains malware or abusive content.


4. Repository Visibility and Collaboration #

Currently, all repositories on Git ‘n’ Coffee are public and visible to other users and the general public.

You may invite collaborators to your repositories. Git ‘n’ Coffee provides basic tools to manage collaboration between individual accounts. You are responsible for managing access to your repositories.

Collaboration features are provided "as-is." Git ‘n’ Coffee is not responsible for disputes, data loss, unauthorized changes, or any other issues resulting from actions taken by collaborators.

Note: While Git ‘n’ Coffee supports collaboration between individuals, formal team or organization-level controls are not yet available.

6. Compliance with Laws and Geographic Restrictions #

You agree to comply with all applicable local, state, national, and international laws when using Git ‘n’ Coffee.

Git ‘n’ Coffee reserves the right to restrict or block access to the Service from certain countries or jurisdictions, or to users suspected of violating applicable laws or regulations, in order to comply with legal requirements or protect the integrity of the Service.


7. Privacy and Data Use #

Git ‘n’ Coffee collects and processes limited personal data in order to operate and improve the Service. This includes account information (such as email address), usage activity, and content you upload (such as Git repositories).

We use this data to provide the service, support collaboration features, maintain security, and improve performance.

8. Service Availability and Termination #

Git ‘n’ Coffee may modify or discontinue the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a disruptive or harmful manner.

Account Deletion and Retention #

You may delete your account and content at any time through your account settings. Upon deletion, your repositories and user data will be marked for removal and become inaccessible to other users.

We retain deleted account data (including repositories and user content) for 30 days after the deletion request. During this period, your data may be restored upon request. After 30 days, all associated content is permanently deleted and cannot be recovered.

Availability and Durability #

Git ‘n’ Coffee makes reasonable efforts to ensure the availability and durability of Your Content. Specifically, each repository is stored on at least two independent servers (not including backups) to reduce the risk of data loss due to hardware or system failure.

However, we do not guarantee continuous availability or permanent storage, and Git ‘n’ Coffee is not a backup service. You are responsible for keeping your own copies of your repositories and content.


9. Intellectual Property Infringement and DMCA #

Git ‘n’ Coffee respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and similar international laws.

If you believe your work has been infringed, please contact us promptly at support@gitncoffee.com with a proper notice containing the required information to file a copyright complaint.


10. Indemnification #

You agree to indemnify, defend, and hold harmless Git ‘n’ Coffee, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:


11. Reservation of Rights and Moderation #

Git ‘n’ Coffee reserves the right, at its sole discretion, to remove, restrict, or disable access to any content or account, including without limitation for violations of these Terms, security concerns, or abuse of the Service.


12. Disclaimer and Limitation of Liability #

THE GIT ‘N’ COFFEE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE PRESERVED WITHOUT LOSS. YOU USE THE SERVICE AT YOUR OWN RISK.

NO INDIRECT DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIT ‘N’ COFFEE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, OR PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

LIABILITY CAP: IN ANY EVENT, GIT ‘N’ COFFEE’S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU IN FULL.


13. No Warranty #

Git ‘n’ Coffee disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is provided "as is" and you use it at your own risk.


14. Third-Party Services #

Git ‘n’ Coffee may rely on third-party service providers (such as hosting, storage, and email delivery). While we make reasonable efforts to choose reliable providers, Git ‘n’ Coffee is not responsible for the availability, performance, or actions of these third parties.


15. Force Majeure #

Git ‘n’ Coffee is not liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet service provider failures, governmental actions, or power outages. These events are considered "force majeure" and may affect Service availability or performance without liability to Git ‘n’ Coffee.


16. Security Disclosure Policy #

If you discover a security vulnerability in Git ‘n’ Coffee, please report it to us at security@gitncoffee.com. We request that you follow responsible disclosure practices and do not publicly disclose vulnerabilities before we’ve had an opportunity to investigate and resolve the issue.


17. Changes to These Terms #

We may update these Terms from time to time. When we do, we’ll revise the “Effective Date” above and notify you if the changes are significant. Continued use of Git ‘n’ Coffee means you accept the updated Terms.
